Same company, different city?

    Hi guys, just wondering if anyone knows if you can work for the same company on a WHV for longer than six months if it's in a different city? My girlfriend works for a retail store in Sydney but she has completed her six months there. She has the opportunity to work for them in Adelaide but would she be able to considering it would be over the six month visa limitation?

    If you are referred by an agency or labour supplier to a business, you can work for six months for that business. The same agency or labour supplier can refer you to another business where you can work for another six months. For the purpose of the six month limitation, the 'employer' is considered to be the business for which you are working directly, even if you are being paid by an agency or labour supplier.

    Working for longer than six months with the same organisation, regardless of whether the duties or location of the employee change, is generally not allowed. A Working Holiday visa holder may, work for independently owned franchises located in different areas for up to six months at each, as long as the franchisees are different employers with different Australian Business Numbers.

    You cannot stay in the same job beyond six months by using different employment agencies, business affiliates or sub-contracting arrangements.

    If you hold a second Working Holiday visa, you may return to work for a further six months for an employer with whom you worked on your first Working Holiday visa.

    Further to the answer from Hussey - if your GF wanted to remain on in Australia, she would need to do 88 days (3 months) regional work - so 6 months in Sydney and 6 months in Adelaide in a retail job would not meet these requirements.

    She would need to do harvest work - fruit picking, farm work etc during the first year to avail of the second year working holiday visa extension.

    The official line from DIAC is that the second company must have a different ABN number.

    So if the organisation has different ABNs for its Sydney and Adelaide outlets - which is very likely, then your GF is totally fine to work for 6 months in both places.

    Cheers for the info guys. I had thought that if the ABNs were different it might be ok alright, we'll have to look into that.
