    What are the penalties for the possession of firearms without a licence?

    I went away from Ireland temporarily and I have discovered that someone has taken control of some legally held firearms i.e. they were legally held by me in my name. This person does not have a licence in their name. He gained access to the safe they were being kept in.

    What can be done?

    Have you told him to return them? How did he gain access to the safe?

    He gained access after he searched my room and found my spare key.

    What are the likely consequences for him? Would I also be in trouble?

    I was thinking of giving him the option of surrendering the guns to the local station.

    Mate you know he is in possession of firearms he is not licensed to have. As a gun owner its your responsibility to secure those firearms.

    I am presuming you are out of the country which is problematic for you.

    The fact of the matter is you need to re-secure those firearms or call the Gardai and tell them where they are as soon as possible so someone can.

    The easiest thing would be for whoever has them to give them back. Is the person who took them refusing to return them to you? When you say that they were held legally by you do you have still have up-to-date licenses for them?

    Possession of a firearm without a licence is quite a serious offence and the penalties can be high. You should also be aware that since two years ago it is also now an offence to fail to promptly report the loss or theft of a licensed firearm.

    Yes they are still licensed.

    If I make a report to the Gardaí what is likely to happen?

    You need to inform the guards immediately if the firearms are no longer in your posession. If you don't do that then you will be in trouble.Were the firearms secured in an approved safe?

    I would only be guessing if I told you what I think would happen if you make a report. What is sure is that failing to make a report within three days of the theft or loss is in itself an offence and you can land yourself in trouble.

    Ring your local garda station immedietly and tell them the story.
    Do it before either the weapons end up in the wrong hands or an accidental discharge seriously hurts someone.
    Or worse.

    Edit that there already in the wrong hands
