Advice on paypal Dispute

    Hi, i purchased a game from zavvi.com on the 29th of November. The game never arrived and i contacted zavvi and was told i had to wait til the 20th of December until they acted on it.
    I contacted them on the 20th to report that it still hadnt arrived and got no response. Got pissed off waiting on them to reply and opened a paypal dispute to get my money refunded.
    Today i got an email from paypal saying they were investigating and stated -
    "If you still haven't received your item, you don't need to do anything. We
    will review the information submitted by the seller, and this investigation
    will continue. We'll notify you as soon as we get more information about
    your case."
    Not long after i recieved this email i got one from zavvi asking me to fill out a pdf and email or post it to them and they will investigate it.
    What should i do here, should i do what zavvi asked or leave it with paypal?

    Communication is the key to solving any type of dispute - I can't stress this enough .
    You done the right thing and opened a Paypal dispute - this will get the ball rolling .
    Its obvious that Paypal have now written to Zavvi asking them for their comments - and for them to reply , they are asking for your help.
    Paypal will ask Zavvi to provide a tracking number to confirm delivery , and if one is not available , they will report back to you with a decision .

    You have nothing more to lose , so communicate with Paypal when requested to do so , ( as it stands you need not do anything ) and fill in whatever you are asked to do by Zavvi and return it to them .

    At the end of the day , if Zavvi are unable to confirm delivery , you will maintain your rights .

    I should fill in zavvi's application form even though paypal say to do nothing further as its in their hands?
    The form they sent me seems rather pointless, asks if ive recieved my package and asks have i contacted royal mail. As for tracking information there wont be any id imagine, this was my first order from them but from speaking to friends any orders have just arrived standard post without a tracking number.

    Look at it from Palpal's point-of-view ........You cannot do anything until they revert to you .
    Understand the dispute process - as I outlined above .

    However in my opinion , you should be proactive and communicate wth the seller.
    They have asked you to fill in a form , and if you refuse to do so , its possible that Zavvi will reply to Paypal and tell them that the buyer is not interested in solving this dispute .

    It is in your best interest to pursue this claim for non-delivery as you see fit and I am only offering an opinion.

    So ( imo ) answer the questions as asked , but bear in mind that it is not your responsibility to contact Royal Mail .

    Its important as well to remember that you cannot use Paypals dispute resolution system after 45 days from the date of purchase. However once you have exhausted their process you can file a chargeback claim with your credit card provider.

    I sent them back their utterly pointless form and im expecting them to ask me to contact royal mail myself, according to the paypal dispute they havent answered them.
    Would first class Royal Mail even have a tracking number?

    No, it does not, and Zavvi generally don't send things by registered post anyway. Ignore any attempt by them to fob you off to Royal Mail, it is not your responsibility to chase this, it is theirs.

    If they don't respond to the Paypal claim within 10 days you'll automatically be refunded.
