Summons after Gardai said nothing on file

    Hi

    Much earlier in the year my husband was caught on his phone, caught absolutely and we have no bother with the fact he was caught... but we went about 5 weeks after he was caught to Swords Gardai station (I took down a note of the date and the Gardai number of the person we spoke to in the station) we explained that he had been caught on the phone and we were expecting a fine, but as yet hadnt received it (post is pretty poor in our block) he looked on the pc and said he had "nothing on the system and we should forget about it).

    A couple of months later we did get a letter saying that as the "fine was unpaid, we would have to go to court and obviously the statutory statement that the fine is more!"

    My legal question is, we have no problem paying the original fine, we even went looking for it, but how succesful will we be at removing any additional fines from it? the letter we received was a few months ago now, and we haven't had any since then.... I was considering we brought a few pics of the letter box's incase they were relevant as they are not very secure, we are sure someone is taking the letters from our box when we are out during the day.

    Can I just point out before anyone starts to get "I told u so" this is my HUSBAND I do NOT and WOULD NEVER talk on my phone when I am driving. We have spent a long time arguing over this so lectures are not required ..xx
