Hi folks,My daughter was due to go on maternity leave on the 22nd of February 2012. The shop she is working in is now closing down on the 31st december.
She does not have enough stamps to claim unemployment benefit. Her husband works so she will not be applying for ua. She has been told that she will now not get maternity benefit as she has no job to go back to.

I have searched the site but cannot find the info i am looking for. Any help would be much appreciated.

Has she already applied? When is she due?

You can apply to go on maternity leave at 26 weeks pregnant. It's not tat she doesnt have a job to go back to but that she is not working just before she goes on maternity leave. If she was due to go on mat leave on the 6th of Jan, she would probably get it as she may have 1 weeks holiday pay.

Even if she has applied, she could ring the MB offices, I found them surprisingly helpful. MAybe she could change her dates.

If she doesnt get MB, still apply for UA, even if she is just 'signing for stamps'.

Get the form filled out ASAP from the doc then work and apply to start mat leave from say the 10th of Jan. She will still only get 26 weeks of payments, but will earn a PRSI contribution for each week. So may be entitled to JSB after mat leave.

It is not the employees fault that the business is going to the wall. Once she get on to maternity leave, that's the main thing. You're supposed to give 6 weeks notice of maternity to the benefit section but I got a letter back within 12 days saying my application was approved and giving the date it would be in the bank.

She may not get paid for a few weeks but they will back date it.

I only know of someone who's place of work went out of business just after she went on maternity, but there was no issue in getting paid.

Download the form from the internet, get the doc to fill out the last page then get work to fill out the employment page.

    http://www.welfare.ie/EN/Forms/Documents/mb10.pdf

If you cant get to the doc in time, then just get work to fill it out. It only asks for the employee's previous 4 weeks pay and deductions. Then get the doc to fill it out. Its not exactly how it should be done according to the form but this is a special case.

I gave one sheet to the doc and 1 to work on the same day and sent it away when they returned it to me.
