If a husband refuses to sign a separation even though he's totally at fault over the breakdown of the marriage what options are available to the wife? is court proceeding the only real option.
Any idea what the costs are of starting a court action?

Its my understanding that the issue of ' fault ' has absolutely no bearing in the circumstances you outline , remember that Divorce here is strictly on a ' no fault ' basis.

Irish divorce is no fault, consult a family law solicitor who will advise on proceedure and cost.
If you are unable to pay apply to your local Law Centre for legal aid.
My advice is to skip the seperation and go straight for divorce, otherwise you'll end up paying twice for the same result.

Can only do so if the required time of separation has happened. Our divorce system contrary to common belief is non fault. In other words it matters not that he was a slut all that matters is that ye are seperated the required time.

The length of time seperated does not matter, how long a normal relationship has not existed is the way to judge.

Thanks for the replies but I'm just talking about a separation agreement not a divorce.

    Thanks again

    No fault principal still applies.
