    What is the sub judice rule?

    Sub judice literally translates as “under judgment” and means that a case is pending before a court. Where a matter is pending then it is contempt of court to publish material which “prejudges an issue”, is “calculated to interfere with the course of justice” or which creates a “real risk that a [party] will not receive a fair trial”. This usually involves material which would tend to prejudice a jury in a criminal trial. It reflects a judicial concern about “trial by media” – or now, perhaps, “trial by social networking”.

    When is a matter pending?

    The sub judice rule is intended to protect the administration of justice in pending cases. In criminal matters, a case is not pending until a person has been charged. The fact that proceedings are likely or even imminent does not mean that they are pending. However, once a person has been charged then the sub judice rule applies even though the actual trial may be some time away.
