Parking ticket advice

Just looking for some advice on this, I got a parking fine a few months ago in Newbridge, i collected my car from the garage (off the road for 1 month and 8 days getting work done on it) and went to work. - live in wicklow and work in kildare.

While on my way to work i decided to get the form signed by the gardai as it was off the road and i wanted to tax it the next day. So i decided to stop in newbridge. i bought a valid parking ticket for an hour and was 15min max in the station.

Got a parking fine for non display of tax, when i rang they informed me i could appeal - which i did and sent the current tax disk. appeal was denied a couple of weeks later, and they gave me 10 days to pay. I am struggling to make ends meet these days and i just wanted to spread the cost which they wouldnt allow me - fine went up from 60euro to 230 and now its passed off to a solicitor.

    Any advice?

Who issued the fine, a Garda or a traffic warden?

    What do you mean here?

Normally it goes to court for non-payment. My advice is go to court, tell the truth, and it will most likely be struck out.

FYI, if you move to a 'smart' meter electricity plan, you CAN'T move back to a non-smart plan.

You don't have to take a 'smart' meter if you don't want one, opt-out is available.

Buy drinks in 3L or bigger plastic bottles or glass bottles or cartons to avoid the DRS fee.

suppose i didnt make myself clear - i wanted to pay the fine but they wouldnt except any installments - they wanted full payment! then the fine went to 230! they passed it off to a legal company and if i dont pay they will prosecute

How come it would be struck out?

do traffic wardens even have the right to fine for tax offences when the car is parked? I thought they have to catch you driving the car with out of date tax in order to be able to fine you.

Relying on it being struck out when it gets to court would be a hazardous route.

At what point do you think a parking warden would have interaction with a vehicle?

Once the car is on a public road, it is liable to show a valid tax disc.

Very much so, Traffic Wardens have legal powers to impose fines for vehicles committing traffic offences relating to being stopped or parked in a public place and for motor tax.

If I understand correctly, you told the Gardai the car was off the road which was why it was not taxed? And were then caught using it untaxed?

If good intentions - getting it taxed tomorrow - were a defence, none of us would have tax paid.

Go to Court, demonstrate you have the car taxed and hope for the best.

This might sound mad but go to court. Seeing as you are stuck. Dont bother with a solicitor. Explain your case yourself. Its a minor offence and requires no legal expertise.
The solicitor could cost you upwards of €150 on top of any fine you might possibly get.
But remember you HAVE committed an offence no matter your intentions and it having been seen parked without tax displayed.
If your lucky the judge will be in a godd mood and strike it out.
