Legality of lifting rails on lines...

    I have seen references to this in a few places on the interwebs*, but does anyone know anything about the legality of removing rail from lines that although disused are still classed a part of the Irish rail network?

    Does a line have to be abolished before the rails can be removed ?

    There isn't any legal problem with it happening. The network is privately owned, even if by a State owned company, so if no services are being run on a line and no hope of same then it isn't hindering anybody as such. From what I know, there are not many places where the track has been removed (Parts of the Youghal and Fenit Branch are obvious ones) so it isn't widespread. And to be honest before they closed the track and per way on these lines needed relaying were they to be reused again given their ages, state and condition so if a freight customer wanted use of them then they would need investment .
