Recently i got caught with 3 ecstasy tablets i was searched by the gardai.
I have no previous convictions(never even seen the inside of a garda station before)the guard said i would be charged under section 3(what is this)i never got a charge sheet yet though. What type of punishment will i be facing? And will this affect future travel i was planning on going to Australia?

Go to a solicitor in the District Court area that it happened in. Some DJ's may apply the probation of offenders Act others may not it really depends on the judge and a local solicitor can advise you best.

Section 3 is the misuse of drugs act 1977. The only advice I will give you and I give it because it is not legal advice, have regular urine tests with your GP to prove you have given up the Drugs.

If the matter is to go ahead you will be served with a summons in due course.

max 250 euro fine and 12 months imprisonment for that offence i think. You need to get a solicitor for this one I would say!

You might as well put that passport in the bin now. Austrailia, Canada or the USA especially won't want to know of you. Well done mate. Being in possession of drugs is daft enough as it is but when you're trying to get out foreign makes it a double whammy of daftness.

Thanks for the advice does any one know how long it would take for a urine sample to come clean this would of happened 9 days ago and does anyone have recommendation for solicitors in the Sligo area ?Would it be possible to get away without a conviction if i offered to make a donation to charity the embarrassment of having my name in the local paper is punishment enough.

    Hi there
Just giving you my input, it may not be correct but no point in worrying too much about it now whats done is done.

( 1 ) If you have to go to court you will get a summons

( 2 ) between now and if you have to go to court keep getting urine samples that show you are totally clean

( 3 ) stay off all drugs they only bring misery to you and all your family around you

( 4 ) If you want to get a buzz , go have a nice drink, dont over do it either with the drink

( 5 ) For 3 ex tablets you are possible looking at a fine you wont get locked up if its a first offence

( 6 ) your riight the embarresement is worse than the punishment but why ever bother with these drugs at all , and also I hope you were not selling them because thats even worse.

( 7 ) So just chillax, dont panic , if the summons does come then just seek good legal advoce, but stay totally away from all drugs you have been warned
    thats it take it handy

If you get the benefit of the Probation Act as a punishment you will be ok to go abroad as it is not a conviction.

You need to get a solicitor.

It's a first offence and if you are pleading the priority should be to get you the benefit of the Probation Act.
The effects of a conviction on job prospects at home and abroad and an out of character moment of madness are usual excuses.
In some courts the offer of a donation to charity can work.

I do admire peoples non-legal pontificating advice/judgements here

Maybe we should just start administering justice here. Save everyone a fortune :-p
