Micorsoft Software Deployment Summary

    I got an email from Microsoft asking me to complete a Deployment Summary excel spreadsheet. Am I obliged to complete this?

    The email also contained an incomplete summary of previous open/volume licensing software we had. We abandoned the open/volume licensing model in 2004 and have been using OEM since. Back then we had approx. 50 users on an MS network, now we have 25.

    Just wondering if I have to complete the survey.

    I'm not sure who the BSA people are, but lets say a request came into my house for information about what software was installed on my computers, I'd laugh at it (partly because I don't use licensed software, but largely because I wouldn't feel obliged to answer any questions about anything private like that).

    If you've nothing to hide, maybe it's better to answer it. Personally I dislike the idea of being told I need to answer questions like that.

    The email came in to work. It is very pleasant and polite but with a bit of a threatening undertone, including this little section:

    What right does Microsoft have to request this information from me?
    Both the Open and Select Licensing Programs carry certain rights and obligations on the part of both Microsoft and our customers. Under those agreements there are certain audit rights for Microsoft. Following is an example of a clause from a Microsoft Volume Licensing Agreement:

    You agree to keep all usual and proper records relating to the products you run. We may request that you conduct an internal audit of all Microsoft products in use throughout your organisation, comparing the number of products in use to the number of effective licenses issued in your name, at any time up to one year after the authorisation number expires. Following any audit, you agree to deliver to us a written statement signed by your authorised representative, certifying that either (i) you have sufficient licenses to permit all usage disclosed by the audit or (ii) you have ordered sufficient licenses to permit all usage disclosed by the audit. By requesting an audit, we do not waive our rights to enforce this agreement or to protect our intellectual property by any other means permitted by law.

    What happens if I don’t complete the information?
    We hope that most of our customers will work proactively with us to ensure a compliant licensing position. However, given the great emphasis Microsoft places on protecting its intellectual property, for those organisations that don’t wish to engage in this process, a more formal communication may be made with respect to our licensing rights and your organisation’s obligations under your Microsoft license agreements.
    The Business Software Allianz (BSA) are a group of software companies, including Microsoft, who check up on companie's software licencing. They've handed out some hefty fines.
