Any advice on mobile isurance scam?

I purchased a mobile phone, with an 18 month contract.

After few months I noticed there were 2 Direct D charges for few Euro each which were (after detailed examination) for insurance for my phone. Surprised, because I never take insurance and same was in this case.
I mailed and phoned with complain both operator and insurance firm and after few hours I've been informed insurance policy was canceled.

Rep in store set insurance for me (while I signet contract for my mobile and presented all necessary info (bank details etc.) without my knowledge or consent. He even hadn’t asked me if I wanted insurance.

So, insurance was terminated immediately and in few days I received call somebody said apology and that they will reimburse those 2 payments.

Guess what. They hadn’t paid yet. It was 7 months ago. I rang them again last month and chap from help line assured me it should be managed by Dublin office already.

Any chance to take legal action in this case?
