    If this is not in the right forum i apoligise and please move accordingly mods.

    Basically 2 weeks ago i ordered an indian for me and my hubby online( they have a site where you can order and pay for food with credit card) I got an email from them confirming the food had been paid for with credit card.

    However a delivery man came to the door and said the payment had been declined, i called the restaurant to be sure and they said it had been declined by the bank. So i paid in cash at the door and that was that.

    Then Friday i recieved my credit card statement on which it said that a payment had been applied to that restaurant. I called the bank and they said the payment went through straight away.

    So i called the indian and got a very ignorant man on the phone so, i went down myself. And after talking to the manager they wont give me back the money for the take away, they will offer me a credit note to the value of my take away.

    But they took double that amount on cash and my credit card, and wanted proof that money was taken off my card for it. After showing them this they still refused to give me my money and would only offer me a credit note

    Can anyone tell me my rights on this

    Get your bank to do a charge back on the card. Hurry though cause theirs a time limit on it.

    Tell them they have 2 choices 1 return your money, or 2 you will go to both your solicitor and the guards.

    If the food was any good then I would just order again and use credit note otherwise go with above.

    Just as an aside on a few occasions when I have paid for takeaway online I have been asked for cash, not sure if it was just an error or more but just said already paid and took food.

    the food was nice, it was a rare treat though only reason we could afford it was i won 20e on a scratchcard so we said we would treat ourselves. just paid with credit card for convienance:(

    wont be doing it again!!!

    i work in a retail "ish" job . i deal with online payments . i read a leaflet the last day about online transactions. you have 120 days to dispute a payment just ring up and tell the bank that u wish to cancel the payment. its then up to the Indian to prove that it was infact a correct payment , after you have paid the cash i doubt they will try and fight for it

    hi all thanks for the replys.

    I got a call today from the restaurant saying that they were withdrawing the "offer" of the credit note as "I had paid with credit card and refused to pay the delivery driver"

    HUH!!!!!!!!!!!!!!!!

    That is balls!

    I said "i called you when he came to the door and you told me the payment had been declined" to which they stated that "No call had been recieved, no money had been recieved and that a credit card payment had gone through"

    So basically they have taken 2 payments from me and at 1st they said the c.c payment had not gone through and took cash, now they are saying the c.c payment did go through and that i didnt give the driver any money:mad::mad::mad:

    When i gave the driver the money he took the reciept off the bag to check how much i owed him and didnt give it back, most take aways ive gotten do this but now it seems he took away my proof of payment!

    UUUGGGHHHHHHHHHHHH!!!!!!!!!!!

    Well you have your answer, ring them back and tell them you will now be making a complaint to the local Garda. Then make complaint it is theft plain and simple.

    It's more like making a gain by deception than theft.
