Casual Trading Act 1995

    Quick one.

    Does hire of goods come under the remit of the Casual Trading Act?

    I've looked at the Act and the definitions, but it only refers to sale of goods, hire is not included in the definition.

    "“selling” includes agreeing or offering to sell, or displaying for sale, or inviting an offer to buy;"

    There is no disputing the intention to trade but is it Casual Trading?

    The goods would be hired from a vehicle or stall.

    Are you not selling a service by offering products to rent?

    Edit: Having read the whole legislation Section 2 says:
    2.—(1) Subject to subsection (2), “casual trading” means selling goods at a place (including a public road) to which the public have access as of right or at any other place that is a casual trading area.

    So maybe it isn't covered by the Act.

    OP best people to contact is your local authority, they issue the casual trading licences, and may be able to tell you of local by-laws that allow/prohibit the service you're talking about.

    Thats the crux of the matter. The council are telling me it is casual trading because it is the intention to trade.

    I don't accept that just because a Council say something, it is correct.
