UPC installation

When I got a new aerial and satellite dish I paid a guy €100 to fit them. He mounted them to the chimney, lifted a roof tile and brought the cables through the attic.

I rented my house out for a while and the tenant got UPC to install cable (without permission)

The idiot from UPC trailed the cable down the side of the roof, along the roof, down along the wall, drilled a hole through the wall, and installed the UPC point on the interior wall.
Then left another cable trailing down the other side of the roof. I assume it went through a vent or open window.

It looks ugly from inside and out.

Do you reckon I have a case in asking UPC to remove these eyesores and fill in the hole in the wall?

Or should I just phone UPC re: an installation and when the guy comes tell him to take all the crap with him?

The way I see it the problem is between you and the tenant.

Well I clearly had some trouble with the tenant.

That's not what I asked though. IMO UPC had an obligation to establish whether they had permission to carry out the work.

It looks as if your problem is with your previous tenant. A quick read of Section 5.6 of the UPC T&Cs

''You have responsibility for obtaining any rights and permissions necessary in order for us to connect and maintain the equipment''

So, UPC would have worked on the understanding that your tenant had your permission, so any redress that you may have is from them & not UPC.

You could seek legal advice to confirm, but lets face it, it would be a fundamental error for them to have been operating for so long without having an airtight condition in contracts covering themselves in this regard.

That's not an airtight condition. That just leaves the tenant liable to UPC recovering costs from them. I personally did not agree to any UPC T&Cs

Have u ried to ring them and ask to remove cables yet and explain u never give permission for tenant to set it up, if not I would suggest to do so at least you know where u stand then and can start looking into other options if they refuse to do so

They did have permission to carry out the work; from the tenant. Its not UPCs business to go about checking if tenants got permission from their landlord to carry our work on a property, or if indeed whether or not they are tenants or if they own the property. This is an issue between you and the tenant. If you feel that he caused suitable damage to the property then you can withhold his deposit in order to repair said damage.

When I worked for UPC the tenant we would always ask if the tenant has permission for any holes to be drilled through walls etc, and the answer was always yes and the tenant would sign to say such.

To be fair UPC has no way of knowing who owns a house and in many cases a tenant will always say they own the place. Many landlords get an independant installer to run cables etc to all rooms or the main room and provide a service such as a fta box and a terrestrial aerial that the tenant can upgrade easily to sky etc or UPC should they want more channels.
