    HI,

I have read this thread completely and dont want to rehash any of the arguments therein...

But my question is.....looking for opinions...not advice.

I am representing myself in a Divorce application - separated 5 years - no Judical Separation but a deed of separation is in force. We have split assets and have agreed access to children. Maintenance remains a contentious subject as I have been the only earner for a number of years but my spouse has recently returned to the workforce.

My spouse is not responding to any communication and I need to bring the issue to a head. I intend issuing a Civil Bill from the Circuit Court and following the Affidavit procedures. The question is if my spouse makes an Appearance to indicate she will contest the grounds does the process still continue....ie do we get a court date and if we cant agree on terms in the intervening period will the judge make all the decisions on the day ?

If by issuing the bill I get my spouse to at least come to the table can I ask for an adjournment if we are making progress but not complete by the time the court date comes around ?

Does the Judge take a view if he is asked for an adjournment...?
