Can we claim JSA if made redundant again?

    Hi, my partner was made redundant a couple of years ago and we have been on JSA. If he was to get another job and got laid off again within a year, does that mean we would then be ineligible for JSA?

    Once he satisfies the means test and is genuinely seeking full time work then he will qualify for J.S.A.

    If he works for at least 13wks and is paying A rate prsi contributions then he would re-qualify for Job Seekers Benefit.

    Not sure if he would get the full rate or how long JSB would last in that situation.

    You may requalify for Jobseekers Benefit after paying a stamp for 13 weeks however the amount you would get would be based on your having earned a weekly average of more then €300 in the relevant tax year which for this year is 2009 and next year its based on earnings in 2010. If your partner was made redundant in 2009 or earlier then he would not qualify for a full payment if he loses his job next year.

    If he is out of work again next year he can go back on Jobseekers Allowance on condition that he is avaiable for work and actively seeking work.

    amtw is the reference to ''earnings' only in relation to 'Re-qualifying for JSB'

    Just want to check because I've never heard of 'earnings' been taken into consideration as regards Benefit in general.

    danjo-xx. I cut and pasted the paragraph from Citizens Information .ie, earnings in the relevant tax year are taken into account for Jobseekers Benefit.


    "Reduced rate of Jobseeker's Benefit

    Jobseeker's Benefit rates are graduated according to your earnings in the relevant tax year. Since January 2009, a reduced rate of Jobseeker's Benefit is payable if your average weekly earnings in the Relevant Tax Year before you became unemployed were under €300. Your average weekly earnings is your gross yearly earnings from employment divided by the number paid A, H or P contributions in the Relevant Tax Year."

    Hi, thanks for your responses.

    It is just that we had heard that if he got a job that was to last for say for only 10 months (a lot of his type of work is for specific projects, once completed he gets laid off again, despite the promise of a permanent contract!) that he wouldn't be able to claim job seekers allowance within one year of signing off in the first place. So, what I mean is, if he was to sign off in January 2012 to start a new job, got laid off again in October 2012, would he be able to claim Job Seekers Allowance from the October or would it be January 2013 again before he was able to claim - I don't include waiting times in that!

    Of course he can claim jobseekers allowance again. Even if he only got a contract for 2 months he can claim jobseekers allowance again.

    Thanks for that, but I couldn't find anything on any of the websites to support that, it seems he was told that he couldn't claim within a year by the CWO. I am thinking that perhaps she was meaning Job Seekers Benefit, but would really like to be able to confirm that.

    If he was previously in receipt of jobseekers benefit and his benefit was exhausted if he has paid 13 "a" contributions since day 156 of his jobseekers benefit claim then he will requalify for jobseekers benefit.But he may only have entitlement to the very basic rate depeding on his weekly earnings of the relevant year. But he can certainly claim for jobseekers allowance.

    Not only can he claim Jobseekers Allowance again but if the new job finished before a year has elapsed, it would be known as a 'repeat claim' and would give him certain entitlements.


    Repeat Claims
    A person who is employed for 4 or more consecutive days and becomes unemployed, s/he may make a repeat claim for JA when that employment ends.

    Where a person re-applies for JA within 52 weeks of a previous JA claim, s/he is entitled to receive the same rate of JA that was previously in payment subject to any change of circumstances and budgetary increases


    These are termed as repeat claims.
