How long should european law (or a european ruling) take to transpose into Irish law?

    Query is as per the thread title - how long should it take to transpose european into Irish law? I am thinking in terms of this subject discussed here. That ECJ ruling back in 2009 suggested that it was up to member states to amend their own relevant national laws in accordance with the findings of that ruling. 2 years have passed and no change has been made to the relevant act i.e. The Organisation of Working Time Act 1997.

    Any insight into how long this will remain unfinished business would be welcome. Also, is there a point whereby IRL would be penalised by Europe for not doing so?

    I guess I figured (and feared) as much. In the case of this particular item, there seems to be a consultation process ongoing right now. IF changes are made, will they be compelled to include this item highlighted by the ECJ? Furthermore, the fact that there is a consultation process in place - does this mean they are within a certain (approx.) timeframe of getting this (and whatever other changes) enacted? What sort of guestimate (ballpark) would anyone care to put on that?

    How long they should take and how long they do take are usually miles apart. :D

    Isn't there a period after which you can act as if an EU direcive is law with impunity.

    IE lets say the EU sets out a directive instructing all states to create a law for paid paternity leave, after a few years the government does nothing, you can just take time off work after the birth of a child and sue for payment of paternity leave.

    There is a prescribed period defined for transposition.

    In one of the articles of the relevant directive there will be guidance on the maximum length of time for transposition.

    If the Member state is late in transposition it can be fined.
