Nooooooooooo! my disk got scratched. Can it be exchanged for another copy?

    Long story short.
    Bought Modern Warfare 3 on Wednesday from GAME. A few minutes ago I was strectching over to grab my xbox 360 mic .. and tipped the console with my foot (Console was in a vertical position) .. heard mad scratching noise .. now the disk is scratched and wont play :(

    Will I have any problems exchanging this for a new copy in GAME?
    The only reason I ask is because any time I bought a game in GameStop they asked for optional 'Disk Protection' which makes me worry now if you scratch a game, even days after purchase, tough sh*t?

    any help much appreciated :)

    don't they do a disk repare thing in smyths toystore? and sorry but its technically your fault for damaging the disk :( but deffo try smyths :)

    If they believe anything other than it was the console moving that scratched the disk, congrats to you for that one and shame on them for being so stupid! :P €3 to get it repaired in any Smyths store, job done

    I shall try and post my failure or success on boards when I bring it back either tomorrow or monday :pac:

    But theres no gurantee on games anymore? ... I mean, its only 3 days old (as of Tomorrow/Saturday)

    There probably is, against faults whose responsibility lie with the manufacturer (ie game never played in the first place), seeing as the fault was caused by you just go into Smyths and pay whatever it costs to get it fixed.

    Aren't gamers on here the same people who took advantage of GAME's 10 day return policy a few years ago with no issue ;) ... playing a game. completing it. returning it with no damage what so ever. Just so they can get their money back.

    Ok, I am going to go down tomorrow or monday and try to get a new copy.

    Hopefully ... and I say hopefully with no ego and certainly hope I dont pox myself.

    But we shall see what a bit of balls and a bit of bullsh*t can hopefully do.

    They will know very well that it was infact your fault that the disc was scratched. The big circle scratch is a dead giveaway.

    Just pay the 3 euro and stop trying to fool/scam a shop.

    I got MW3 on Tuesday and that night the old unable to read disc error came up. I took the game back to gamestop and they wouldn't exchange it as they said there were 2 small marks on the disc because of "laser burn" and because my xbox caused this said i should have taken protection and offered me another copy for €54.99. I disputed this, but they were adamant it was 'laser burn'.

    I refused to buy another game. Took the 'damaged' game home and gave it a vigorous clean with a lint free cloth. And as if by magic the 'laser burn' disappeared off the surface of the disc ! I realise i should have given the disc a clean before hand but the disc was brand new, gone from the case to xbox back to the case with zero handling problems and looked spotless. The marks were miniscule and were only really visable under a bright light at a certain angle.

    I think the disc protection is a total scam. I have been gaming on the xbox since the original came out and PS1 before that. I have never had a shop refuse to exchange a faulty disc before. This disc protection is clearly a way to get more money from customers.

    I will no longer be supporting my local gamestop and will buy online instead. I may have to wait for the game to get delivered instead of getting the game on day of release, but i know i will be able to get a new disc without any problems like this....rant over:p

    @smiddy Take the game back to them, tell them it's within your statutory rights for either a replacement or refund as the disk is faulty. If they try the laser burn line again ask them are they engineers. They can't simply decide it's laser burn. Be stern and ask to speak to a manager.

    You have a genuine complaint though. I do not condone anyone shopping in gamestop anyway because they are rip off merchants but if you do, then don't scam them like the OP is trying to do.

    You should go back in and give out like the poster before me has said.

    Hope everything worked out for you.

    Happened to me yesterday as well and probably will happen to a few others on here over the next few months.

    What I did was get my mate to call over with his copy of the game, installed it to my Xbox then put my original scratched copy back in. Works a charm!:)
