Child maintenance.

    Hi I recently got a message from my ex girlfriend to say I will be getting a summons to court for protection and maintenance, I have never hurt her in anyway but she sais her mother will back her up that i hurt her in a car crash which I have proof that it was the other motorists fault. my ex doesnt want me seeing my son, is this possible that if i am found guilty to have a protection order against me will it be hard to try have access to my son as i plan to see a solictor next week and organise a day in court. Also a summons for maintenance I have payed maintenance from when my son is a month old he is know 4 months old I am out of work but i have still payed it, I only have a bank statement for 1 month as i thought i could pay cash, if anyone has any advice it would be greately appreciated thanks.

    Your girlfriend is going to the district court to apply for a protection order against you. If she is successfull she will give the protection order to the Gardai and they will serve it on you. you will not then be allowed any where near her. As we here do not know the ins and outs of your relationship with her we do not know wether she will get the protection order or not. She is also looking for maintenance from you. you will be summons to court for this. if you do not turn up the judge will award the maximum amount against you so you need to turn up and you really need a solicitor. apply for free legal aid immediately if you are out of work

    as you need to apply for gaurdianship and access to your son.

    your name being on the birth cert. (if it is) does not give you legal gaurdianship because you are not married to the childs mother. only married fathers automatically have gaurdianship of their children.

    Is it possible for this protection order to go ahead even doh there isnt any proof iv done anything rong, I dont want the judge to make me out to be a danger to my son, If this protection order is used how would I see my son if i cant be anywhere near his mother.

    I am not entitled to any legal aid or social welfare as my father is self employed and I am under 25 and living with my parents.
