Apartment insurance - Neighbour water leak

    Hi,

    Recently my apartment was damaged by a leak coming from the water tank of the apartment above mine.
    The management company gave me the Block Insurance details so I can claim. However, there is an excess of 1,250 euros on the policy.

    Since only my apartment was damaged and i was making the claim, the 1250 euros was MY excess and so came out of my claim.

    Am I really responsible for this excess or should the owner of above apartment pay this?? Anyone got ideas?

    Note: There is no evidence of neglect in any reparation by owner of above.

    You would have to sue the neighbour for the entire cost on the public liability side of the insurance.

    The block insurance in my experience only applies to leaks coming from water apparatus within the common parts. If the leak is coming from within your neigbour's demise (ie with his apartment) then it is generally his problem to remedy the damage. I have been on both ends of this one - have leaked out and been leaked into. It should not be your issue at all - you should discuss with your neighbour and arrange for him to have access to inspect and then to remedy.
