When the PIB receives word back from the insurance company to say that they are OK with the claim, does the PIB get a up-dated medical report from the persons GP or if a solicitor is acting on be-half of the person, does the solicitor get the reports for the injuries board?

The Injuries Board will not ask your own G.P. for a Report, they generally refer you to an independent consultant. So for a minor injury, they might have a different G.P. in your area examine you and prepare a Report, or for a major injury, a specialist. The Board normally write to you and/or your solicitor with details of the appointment.

yes,we contacted a solicitor.the solicitor has sent in the forms.its just my wife has seen a few specialists since then.

Your Solicitor can send copies of those Reports to the Injuries Board. The Board might then ask a specialist to prepare an independent report. If, for example, your wife had to see a respiratory consultant and your Solicitor submitted a copy of his Report, then the Board will probably have her assessed by a different respiratory consultant.

just a query on that, when you mention reports (plural) my solicitor said piab only pay for 1 report and any further reports are to be paid for by claimant and will not be included/reimbursed in their assesment. i was surprised as reports are obviously needed to support a claim and are often from several specialists.

I did,nt know that,so if a few reports are needed, you pay for them yourself???
Another thing,is it that if the claim is over 20k,do the injuries board let it go on to the courts?
I seen somewhere that 80% of the claims are around the 20k mark.maybe the injuries send them on to court when they reach a certain amount????

I don't think there is an upper limit on how much the board can award, but if there is, it is well above €20,000.

Re the reports, I don't know if I can go in to what your Solicitor has said because there is no legal advice allowed here, and I'm only answering generally based on my experience in dealing with the Board. Perhaps ask your Solicitor to explain the situation in relation to your own Reports at your next appointment.

You won't have to pay for the Reports which the Board arranges.

sorry about that, when i re read your message i realised you where referring to the medical from the injuries boards approved drs. i do know that the respondent ( if they agree to the board doing the assessment) has to pay 1200 to cover the cost when the medical boards require there drs to do a report which i believe happens in a lot of cases to assess how long recovery or further consultations will take.
as for paying for my own consultant reports the board will pay for the initial assessment report and if i want to provide any further reports to substantiate my case i pay for those. of course that may lead to a higher settlement which should more than cover the cost. i will check with solicitor on next visit as i think i will have to see a few more consultants for 2nd opinions. i just hope it wont take too long to get that done but it is looking like it could be quite a while and time consuming.

What stage are you at now "over 30"?did it take long for the insurance company to respond to your claim?

hi mickey007 my claim went in last month and i haven't heard anything back yet from injuries board or insurance co. i have to have more medical investigation which by all accounts will take quit a long time. i am tired of all these visits to drs but it has to be done. it will be anything up to a year before there is any settlement with injuries board, that is if insurance co. agree to claim being handled by them. i don't want to be in the position of having settled and then discover something was missed out on. i want to make sure all problems are identified but i have no control over how long it will take.

how is your wife doing now, any improvment.

    Hello
Our solicitor sent in the forms/reports etc,but no word back from either.my wife is still running to doctors and all they seem to be doing is putting her on stronger medication.
As far as i can see from people on here, the injuries board only deal lower case awards??
Has ANYONE got a fair award from the injuries board?

    Hi Micky007,

I wouldn't limit your research to just boards.ie. I've done quite a bit of reading and digging etc. In this life there are simple rules that apply. 9/10 people who get good service/award etc. won't say anything. The 1/10 who don't get good service/award will tell 10 others. So, by human nature, bad news spreads farther and wider than good news.

Regarding sizes of awards yes PIAB deal with all sizes of claims from what I've seen. Do a search for "case studies" and "Injuries board". The injuries board publish case studies with their annual reports and then tend to range from small settlements to settlements into six figures.

I'm probably a couple of months ahead of you in the process. The next thing you will likely receive is a letter from PIAB stating that they contacted the respondent to ask if they are happy for PIAB to make an assessment. The respondent has 3 months to reply.

The Injuries Board deal with higher awards too. According to their website in 2009 the lowest award was €1000 and the highest was €493,902. Their breakdown of awards for 2009 were:
    up to €20k - 63%
    €20k- €38k - 25%
    €38k- €100k - 11%
    over €100k - 1%
