arrested, cautioned - is a summons definate?

    If someone has been arrested for obstruction and given a caution, is it definate that they will get a summons to go to court? And if so, can they go without legal representation (cost issues and employed so they cant get free legal aid)

    If a caution is given, I would imagine that's the end of the matter, unless the person was actually charged I wouldn't expect a summons.

    If you took a caution (signed a form to say you were in the wrong) that's the end of it.

    Signing the form only means you will be considered for a caution. I didn't think obstruction was covered by it though. Either way you'll hear from the Garda, either to arrange for the formal caution or tell you that you will be prosecuted.

    Hello kathleen! I must agree with sdeire. He is right about it was the end of the discussion if you just have been cautioned. There should be nothing follows. If the cautioned that was made led to something like your appearance in the court is needed, then, cautioned is not the right term to described the situation. You were right, that could be "summoned."
    If it is you or your friend that has been summoned of something, i know a law firm that could help assist you in that situation.

    first of there are several types of caution. anybody arrested is read the caution, you are not obliged to say anything yada yada yada. the next is a caution for a statement given to gardai about an event witness statement for example. a juvinile caution is self explainitary. an adult caution is when an adult is arrested for the first time and recieves a caution from the super intendant, now this is important the caution takes place after the arrest maybe in a week or so. the offender is brought of their own acccord to see the super where he has an informal chat about the wrong they committed. some paper is filled out and that's it. no big deal. for the record when you hear caution it might not mean what yu think the word is thrown about a lot in garda and court talk. for instance when a garda goes to court he gives evidence of arrest charge and caution. all a caution is is to make sure a person knows their rights and still to this day nobody does know their rights. thank god for boards. hope this answers your question. so in short caution is just a word if an arrest took place but no meating with super then expect a summons if you recieved paper about a meeting with super good formal caution like a jlo for an adult.
