    If im working 8am to 4.30pm is my normal working week and say today i did them hours and then came back in at 10 pm to 4am,and took the following day off obviously as id be wrecked.would them 6 night hours count as over time as i worked more than the normal hours in a 24 hour period.

    Night pay is time and a third

    overtime is time and a half this is why i ask

    Generally overtimed is determined by extra hours worked within a specific period e.g. week, fortnight, month. If you were given the following day off in lieu of returning that night, I can't see how it could be determined as overtime. If your employer pays night premium, you would be entitled to that. Generally 24 hour periods apply from midnight to midnight and therefore you would only have worked 10 hours in a 24 hour period (assuming you got a 30min break during the day shift.

    Why would you be going back into work so soon ??
    If you've been asked I'd say it's inappropriate to ask employees back in so soon..
    If it's at your request then as a manager I's refuse as it's unsafe...

    Also say you've requested this to accomidate having time off for something when you would be rosterred for work... Why should the company pay extra to accomidate you??

    Having an employee on site again with so little rest period is a legal minefield... if an accident happened due to tiredness the company could be held liable for allowing it to happen..

    Agreed with previous poster. Overtime is usually when you work for more than your usual hours over 5 days.

    If your normal week is 37.5 hours and you work 40, 2.5 hours is paid at overtime rates.

    If your normal week is 37.5 hours, you work 2 hours overtime one day and take a day off (either annual leave or sick leave) that's only 32 hours.. so no overtime for you!

    Another concern is what's in your contract.. even though your usual hours are 37.5, it may say you only get paid overtime for over 45 hours and standard time before then.

    We have a skeleton crew on at night. If one of them goes sick we have to take someone off the day shift and roster them back on duty that night. The only stipulation is that they must go off the day shift by 2pm and have a 6 hour rest period before returning again for the 8pm to 8am shift. They would then have worked 18 hours in the 8am to 8am period but no-one seems to have a problem with it and it's been like that since I began 23 years ago. I presume it's legal as it's in the public service and there has been no objection from any of the representative trade unions.
