Can you sell a site with Outlining Planning Permission

    I have a question regarding outlining planning permission on a site that I bought over 5 years ago (It used to have FPP but that has now lapsed as had no money to build on it) I now have outlining planning permission with loads of the usual conditions one which is that you have to fit the local housing need so if I built I can’t sell it for 7 years on this site) is it possible to sell this site to someone local to the area who would fit the eligibility for local housing need? The mortgage on this site is over €900 a month and I know I would be lucky to get half of what I paid for it or to even sell it at all. I would just love to get rid of it or get some type of income from it to help with the mortgage as have done the interest only and the moratoriums and can't walk away from it as I re-mortgaged my house 5 years ago to buy it. I’ve even been on to Coilte regarding planting forestry on the site for income but it’s way too small. Any advice on this would be much appreciated.

    i dont see why you cant sell it, I've highlighted the important selling point and underlined the actual councils requirement. best of luck, 900quid a month! that sucks, the site must have cost you a fortune...

    councils appear to be sympathetic in these cases.

    what you can do actually depends on the wording of the condition.
    any prospective purchaser will have to show the council that they comply with local needs requirements.

    another far out option is to apply for that condition to be removed... but thats a long shot.

    id suggest go meet the planners, put all your cards on the table and discuss possible options.

    what size is the site? and what county?

    Its in county galway about 2 and a half miles from Kinvara (drumharsna south) and its a little over a half acre

    Cant see any problem with it so long as the buyer would have been entitled to get planning in their own right from the outset. The chances are that any prospective buyer will not part with money until they have full permission so let them go off and do their own thing.

    Ya, you will have to run with a sale subject to planning I would think.
