A friend of mine received a letter from Kilkenny council today saying they had received information that her partner was living at her address. While he does stay there on occasion he does not live there as he works and lives in Waterford. She would like to know is she entitled to be told by the council who made the allegation under the freedom of information act?

    No she's not.

You would use the Data Protection Act. However, there may be separate legislation protecting people who advise the council of suspect situations. In a defamation situation, there may be an argument of privilege.
