ebay problem and dispute

    hello guys I bought an iphone from he states 2 days ago.

    The title says Apple iPhone 4 32GB - Black AT&T (Jailbroken 4.2.1) Unlock Ready


    I won the bid and everything. The seller stated no international shipping but I ignored that as most Sellers as buyer aren't willing to pay for extra shipping fees.

    Anyway I asked the seller if it was unlocked he didn't reply but kept on saying that i send payment to him.

    After paying he said it wasn't it unlocked filled a tracking slip and marked it as shipped.

    i told him to refund me but he wont so i opened a dispute as non reciept, my main dispute should be significantly not as described but i couldnt do that as it will mean i have recieved the ittem which i didn't.


    this happened yesterday Saturday in a space of 30min.

    I questioned him stating the title was misleading as unlock ready meant it could be unlocked but ios4.2.1 cant be unlocked, also it was in the section of the unlocked iphones on ebay.

    my question is what will be the possible outcome of the dispute ?

    The seller will not accept returns for this item.

    Sellers may be required to accept returns for items that are not as described.
    Above is the sellers return policy .
    • Paypal will place the funds on hold
    • Paypal will ask you to return the item to the seller .
    • When confirmation is received of successful delivery , Paypal with return the funds to you .
    ( above is my own opinion only )

    Quite likely they will just close it. You opened a dispute far too soon for non-receipt, and the seller can provide the tracking information to show it is in transit. When it does arrive, you will be stuck with it unless the seller accepts a return (which they're not obliged to do).

    You should note that you cannot change your dispute, nor can re-open a closed one. Unless it goes missing in the post, I really don't see how you're going to win this dispute. You paid for something that you knew was not right, which comes down to being your own fault. Whenever you are not sure of what you're buying, you should never pay. Starting the wrong dispute will also not have helped.

    I won the dispute.
    I paid for something which i thought was right.

    1st. the iphone was placed in the section of unlocked iphones.
    2. the description of the iphone says unlocked ready

    The seller knew what he was doing, you cant make 2 mistakes like say and say he didnt know.

    it was manipulative and his goal was to deceive others which he did to me till I asked if it was unlocked.

    Nice one. I didn't expect that. I've seen many claims like this go against people, but I suppose sometimes it all works out.

    I didn't as well but it depends on the way one words his/her opinion of what the problem is.

    That's one of the main areas paypal claim specialist focuses on.
