2 Fines for no Car Tax

    Hi folks,

    I'm looking for some info.. I bought a car in July from a friend eho was going to Oz. I only started driving it 2nd week of Sept as it needed some work. (Timing Belt Gone)
    This wednesday I received a fine for no Car Tax (Oct 5th @ 18:10) On Thursday I received a fine for no tax disc displayed (Oct 5th @ 18:35)

    I have no problem paying one fine as the tax was up, but paying two fines got 25 mins apart is a bit much.

    I Wasn't stopped by the Guards, must of been one of those cameras that read number plates.

    Anyone know if I can get out of paying one of the fines. Car is now taxed - Back tax paid to start of Sept

    Anyone know if I can get out of paying one of the fines. Car is now taxed - Back tax paid to start of Sept

    Not a chance, both penalties were for two offences. Have to pay up unfortunately.

    MagicMarker is right, you got two fines for two seperate offenses. Not having tax and not displaying a tax disk are treated seperately. Pay up and count yourself lucky that you got away with nearly a month driving without the Gardai pulling you-they could have seized it, then you'd be facing a much larger bill.

    I thought it had to be 3 months out for them to seize the car

    This happend to me before, my car was parked up in a pay and display zone while I was out one night, woke up the next morning to discover I had lost my keys.

    I rang the number on the ticket machine told the guy my problem he said don't worry I will tell the guys (traffic wardens) to pass it by.

    Went back 4 days later to find no parking tickets but 2 tickets for non display of tax.

    Went to court, €150 fine which worked out roughly the same as paying the 2 tickets.

    Lesson learned just pay the damn fines!!!

    Ignore this post, the gaurds would not have the right to seize a car unless the tax was out by three months.

    Sorry to hear OP, don't think there's any way around paying the fines.

    That's not what the law says

    • A member of An Garda Síochána is of the opinion that the vehicle is being used in contravention of Section 56 Road Traffic Act 1961 i.e. The person driving the vehicle is not insured to drive the concerned vehicle.
    • The person driving the vehicle refuses or fails to produce there and then a driving licence then having effect and licensing him/her to drive the vehicle, when production of such a licence is demanded of him/her by a member of An Garda Síochána under Section 40(1) of the Road Traffic Act 1961 and the member is of the opinion that the person is by reason of his/her age ineligible to hold a driving licence, licensing him/her to drive the vehicle.
    • There is no road tax in force for a period of 2 months or greater.

    OP, they are two separate offences, and it's likely that the non-display one was by a parking warden, and a garda issued the other one, hence the time between them. Not that it matters. Pay up and learn for next time

    OP stated that the tax is out since July, which is four months, and the law states that a car may be seized by the Gardai of the tax is out for more than two months. Like I said, Op was lucky that the Gardai didn't pull him.

    surely the fu.kwit that thought up the charge of not having tax displayed didnt intend to use it in conjunction with a charge of not having tax

    Well lads, iv got court on monday the 14th for no tax, i got the fine while my car was outside my girlfriends house unknown to me they did me, i had just bought the car only had it 3 days, didnt have the tax book at the time of the fine, got this fine in the post 3 weeks later and straight away i rang the cop shop and explained that i didnt have the tax book at the time and the car was since taxed, and was told to write a letter to the superintendent as i did i got a call back explaining that when i taxed it i didnt back tax it for the 3 days at the end of the month so now the cop will bring it up in court that i falsely declared none ownership of the car or whatever ya call that, whats the worst that can happen, no previous iv a clean slate, any sort of help would be great thanks
