advice on employment rights needed please

    Hi,

    I am currently employed by a company for the last 10 years, I have just heard that the company is going to shut down and a new subsidary company is going to open up and we are to be transferred across. (the current company is also a subsidary). I have been told my job is safe and will continue!

    Can someone please help me with my queries.

    1. Am I going to be made redundant and the new subsidary company will be considered a new position?
    2. Or am i going to be transferred over to the new company under my current employment contract or new contract?
    3. If a new contract do I have rights to hold onto my current contract?

    Anyone that has been in the same situation I would appreciate hearing what happened to them. as you can imagine my employers are not to eager to share any information with me at the moment.

    To be honest, it depends on what the company eventually decides to do.

    Some companies may transfer you across with the same contract that will probably need to be resigned as it will be under the name of the new subsidiary.

    Others will make you redundant and re-employ you. Others again would make everyone reapply for their jobs!

    I'm no expert on these matters but I'm not sure you would have the 'right' to keep your current contract. It all depends on this subsidiary and how they do the transfer afaik.
