Rules around the surname of a new baby?

    HI Folks,

    Is there any situation where the father can legally insure that his new born baby must have his surname?

    Hypothetically speaking, if me and my wife have a child, does it have to be named after me? Or would this only be so if my wife took my surname after marriage?

    I understand that unmarried then a father has no right but what about when married?

    Its a choice the parents need to make for themselves.

    The following information is recorded in the Register of Births:

    Surname. Since October 1997, a surname for the baby is registered when the birth is being registered. The surname registered must be the surname of the father or mother or both. If you want your child to have a surname other than the surname of the father or mother or both, then an application must be made to the Registrar General or a Superintendent Registrar in writing.

    I know a married couple whose childs birth cert inadvertently gave the mothers surname as the childs surname.
    Neither mother or father wanted this but to get it changed which they eventually managed to do they had to jump through hoops - apparently the bureaucracy was a nightmare.

    I got married in Poland, and in the registration process we had to put down what surname our children would take, as well as putting down what surname my wife would take.

    OP; the HSE have offices which deal with the likes of birth certs, and the head office for this is in Roscommon. If you ring them they can probably tell you, or can show you the various articles dealing with it. I've had to deal with them through their Galway office in the past and found them very helpful.
