John decides to organise birthday party for his wife, Mary. He knows Mary is a big fan of music and when he sees the following advertisement in the local newspaper,he is delighted:

“Band available for parties. Call 12213443 to book”

John calls the number but thereis no answer. He leaves a message saying that he wishes to book the band forhis wife’s party which is on the 10th of October in Main Street pub,Ballyanyplace and that unless he hears otherwise from the band, he will assumethat they will play at the party. He also says money is no object and he ishappy to pay whatever fee the band charges to ensure his wife’s happiness.

John calls Happy Cake Company toorder the birthday cake. He knows that chocolate cake is Mary’s favourite and orders a large chocolate cake from Alison, the owner who is also a neighbour. He assumes that as he helped her to paint her house recently, she willgive him the cake for free but he doesn’t say this to her.

Finally, John, who is a painter, plans to finance the party with the payment he will get when he finishes painting the local church. On the day prior to the party, Paul finishes his work and calls to the local priest for payment. The priest says that unfortunately, he cannot afford to give Paul any money and instead offers to say a birthday mass for Mary. John is furious and says that a mass is not enough and he needs the money and he’ll be back for it.

When John goes to collect thecake on the day before the party, Alison tells him that the cake is €30. Paul is surprised and says that he thought it would be free as he helped Alison paint her house. Alison laughs and says that was merely a favour and John owes her the €30. John tells her he has no cash on him but he’ll come back to her.

At 5pm on the evening before the party, John gets a call from the singer in the jazz band, Rick, to say that hehas only just gotten John’s message and unfortunately the band is already booked for the evening of the party but they would love to play some other time.

John is distraught and calls you for some advice. Can he force the band to play? How will he get his payment from the local priest and will he have to pay Sheila for the cake?

Totally lost on this one folks, could anyone help me? I know its all about acceptance and offer but can't figure each part out, lecturer is useless and won't help me. Any nudge in the right direction would be eternally appreciated!!

    Ricky

As you say, this is based on offer and acceptance in relation to the Band issue. Look at consideration in relation to the other two parts. There's a nudge. Anything more and i'll be doing your work for you. You would find the answer on this stuff with google as it's pretty basic. That's not to denigrate you, just that it is basic contract law. Not tough at all, if you sit down and read the material! Look at Clarke's book on Contract Law for pointers. There's even a famous case as to whether prayers constitute consideration which again you can google!
