Sub judice rule for appeal cases.

    I am trying to identify an Irish decision on the application of the sub judice rule to cases that are under appeal.

    I think that the decision was from the CCA or the SC.

    The core point made was that the rule applied to cases under appeal because judges, like jurors, are capable of being influenced by public debate on an issue.

    I do not know if the thinking formed part of the ratio or if it was said obiter.
