Hypotheically speaking, who would have been at fault for this crash?

    So I was driving home today and I nearly crashed into another car, I live on a country road. The thing is that the other car was not keeping to the left hand side and if anything was on the other side of the road. I wasn't driving particularly fast, maybe 40-50Km max, but I took a slight skid while braking. I didn't see the other car because this happened on a corner. People normally drive close to the left and cars can pass each other with no problems, but this is the first time I've seen someone on the middle/right side of the road and she made no effort to move to the left to make room for me.

    No damage done, but I'm just curious as to who would have been at fault if we did crash. I distinctly remember being told while doing my driving lessons and test that whether you are driving on a primary/secondary/tertiary road you allways keep to the far left. Therefore I think she was in the wrong had there been a head on collision.

    Legally speaking who was in the wrong?
