Length of time to charge, no insurance.

    Just wondering, if someone was in a car accident and it later transpires their ins company had ceased insuring them a few months previously and did not notify them then what happens??

    Is the driver responsible for making sure they are covered at all times??

    If the driver were to be prosecuted for no insurance is there a time limit after the original accident that one cannot be prosecuted? Say it's a year since the accident can they still be prosecuted?

    They were paying in monthly installments. Ins co claimed they sent out reg letter stating no monthly DD was forthcoming and they were ceasing cover. However no such letter was received and requests to furnish proof of letter being sent have proven unsuccessful.

    Can someone still be prosecuted for no insurance if they were not informed they were not covered and genuinely thought they were covered??

    First off there is usually a demand to produce insurance. The demand must be made within one month of the incident. If the demand is not made the prosecution have more difficulty in proving their case. An application for a summons must be made within 6 months of the date of the offence.

    On day of accident a member of An Garda took ins number from disc displayed on windscreen. Was about 12 months after when person found out there was no cover after a call from the Garda to say there wad no cover.
