    Ok my car was seized by the guards today because it was out of tax, They said im getting charged a 120 towing fee and a 35euro a day holding fee, the thing is do i have to backdate my tax or do i just have to get next 3 months taxed

    You mus pay backdate to when ever the car came back on the road or all arrears if car was not off the road

    You will be charged an arrears fee from the begining of the month of expiry when you go to tax the car again.

    From the story of this whiny tax evader :D it seems you should backtax it.

    This one says "Once seized a vehicle will be held in an impound yard for six weeks until back tax is paid and all documentation is regularised"

    Ask the cop that siezed the car to sign the off road declaration, that should sort you out.

    Whats to stop you from getting the form signed for the months previous to the month in which you were stopped,and just pay for the back tax for the month you were stopped during.
    Afaik there is a to and from date on that form.
    Who's to prove it wasnt off the road then?

    The thing is ive asked them but they said i just have to get 3 months tax, But i didnt think that sounded right.

    Can the OP hire a towtruck to take the untaxed car from the compound? If they don't have the money to backtax the car immediately, this might be cheaper than paying the daily charge?

    The minimum you can tax a car for is 3 months. So they're right - you only have to get tax for 3 months and they'll give you the car back. But you'll also have to pay your arrears on top of that 3 months.

    Wait, a sec..
    Its likely he could mark the car off the road upto the end date of the previous month. So he would have to get a signed Off the Road form, pay 1mth back tax and 3mths forward tax all in one go. I see no reason he "must" pay 3mths back tax.

    Seamus didn't say he must pay 3 months back tax, only that he must pay back tax.

    I think Ill try get it backdated till august, they said ive been sited on the road in the last 13 months, which is strange as my car key was burned in a fire and i couldnt afford a new key, then i did ligament injuries when i got my key

    Can we stop advising the OP to falsify their back-tax situation? Read the Charter, people!


    I'd expect it's two different issues for the Garda, paying for a 3 months tax disk, and paying back tax.

    They won't release the car to be driven on the road without a valid tax disk. For you to conform to this, you need to buy a 3 month disk (minimum).

    Separately to this, they have the issue of whether you declare the car off the road previously to this, and whether they can prove otherwise. This won't impact on whether they'll release the car, but they could be waiting to see what you do wrt back tax before the start digging back through their ANPR database or whatever.

    So, when they say, "you only need a 3 month disk", I'm sure they mean "you only need a 3 month disk for us to release the car" rather than "you only need a 3 month disk and you're excused from the back tax".

    Well got the garda to back date it till start of september, Sexy little one she was to :D, Just had to pay 3 months tax, so sept-nov, towing fee and holding fee incase anyone has the same problem
