Appeal against child maintenance order.

    I am appealing against an order that was made against me under The Family law(maintenance of spouses & children) act,1976.Section 5A(1).
    The appeal is against the ammount of maintenance that i have to pay,and i have some questions that i hope that some people can help me out with.

    1.My solicitor from the legal aid board tells me that appeals to the District Court are not covered by my legal aid cert. Is this correct ??

    2.I have sent "the other side" a "summons",by registered post,within the time limits (14 days) post witnessed by a PC as per rules and the completed forms returned to the court clerks office on time. Is this the correct procedure ?? (court clerk was'nt very helpful)

    3.Will the "other side" be able to have her (also legal aid board) solicitor in court on the day of the case ??

    4. How much would it cost to have a Solicitor to rep. me on the day ??

    Appeals to the Circuit Court are covered by legal aid if you qualify for legal aid to begin with. you should be able to get legal aid. Check with your legal aid solicitor to confirm.

    Other side will absolutely be permitted to have his / her solicitor there.

    Cost will vary but if you;re on legal aid, it won't matter. I'd suggest 300-500 would be appropriate as a privat client but bear inmind that this is plucked out of the air.
