Hi, I purchased 2 shirts from ebay from a seller with a good rating based in the UK.
When I got the items they were asian sizing and did not fit.
The seller says they accept returns but are not replying to my emails.
I have a return address, should I just post them to that even if the seller is not responding? Or should I try to contact ebay for help.

Don't send anything without first hearing from the seller. You may need to start a dispute to get anywhere.

Hi thanks for the reply. I have Emailed the Seller on Monday and also Wednesday. How long do you think would be fair before submitting a dispute with ebay?

    Now would be fair enough.

OK I have the dispute in now and the seller has one week to respond. Thanks again for the advice.

ive learned the hard way with sizing issues while buying on ebay, allways ask plenty of questions about sizing of the item your buying, most sellers will be glad to help but if a seller doesnt i just walk away.

I find ebay no longer give a toss about their members,so good luck with your dispute

Thanks sligono1, good advice. The seller has until Friday to respond to the dispute. Does anyone know what happens if they do not?

If there's no reply then you get a refund, that's if this is a claim and not just a dispute.

Ok, how do I tell if I have a claim put in or just a dispute?

I just read reading over the case again and it says

If you don't hear from the seller by 09 Oct, 2011, you can escalate this case to Customer Support.

    You wanted:
You prefer to return the item in exchange for a full refund.

So it will probably be up to customer support to decide.

You have to make it a claim, so if you haven't done that then it's in dispute. If you don't escalate to a claim, the case will close. Once closed, a case cannot be reopened, and you cannot start a new one, so watch out for that. Give the seller a few days to respond, and if they don't then escalate it to a claim.

Still no reply from the seller so I was able to make a claim today and about 10 minutes later the refund had been make to my card. I even got the shipping costs refunded. Disappointed with seller but happy with ebay/paypal.

Make sure you leave negative feedback

Done. I always leave feedback, this is the first time it has been negative.

I just recieved this email from the seller, it looks like their email does work after all!

    dear sir,
please return my shirts, i have got you number, i will call your shortly to discuss. I also have to tell you, if you are not returning them, i will report you to the police. i have your name and address, and prove that you got my items for free.

WOW, don't know what to say about that but it is very threatening. What's the best way to report this to ebay?

    http://pages.ebay.co.uk/help/policies/rfe-spam-ov.html
That should be your starting point. You can forward email messages to them if requested.

Thanks again, you have been a great help. Ebay have been contacted.
I forgot to say they included a return shipping address with that email. Should I send the items back immediately at my expense or wait for a reply from ebay?
I believe the user now wants to harass me because I left negative feedback.
I have never had such bad experience using ebay. :(

Maybe he will pay attention to his communications from customers and Paypal from now on!

Don't forget if he calls you a scammer in any feedback he leaves or response to your feedback, contact ebay and request they remove it

Edit: It is up to you if you do return them, it will cost you the postage. Make sure you reply through ebay at all times.

I will see what ebay says and then see what he says about postage.
My main problem now is that the phone number I have down for ebay is my parents home. I do hope he does not ring them making threats.

    Update
He has emailed me but this time to apologise. He says I am to keep the shirts but begs for me to revise my feedback.

I'm guessing ebay has contacted him, I already got a copy and paste response from ebay about his threats.
