    Some guides would be great needed here,

    3 years ago my mother died leaving her estate in her will to our dad, which passed away recently due to terminal illness,
    We have now discovered that our dad never made a will, what will be the position with regards the house now? theres 5 family members left all married of course,

    i am asking this on behalf of all family members, we just dont want to be vampired by solicotors fees etc,

    All info and guids would be great guys,

    There is an equal share to each child of the deceased. The children of any deceased child share equally in their parents share. the house now belongs to the president of the high court. you will have to take out a grant of administration to real with it.

    How do we go about taking a "grant of administration" A member of the family has been appointed executor by the rest of the family in the presense of the solicitor who was dealing with the will when the mother was alive and he also has the deeds to the house from when she was alive, Now he never passed them onto the father when he went to see him after she had died, we thought he made a will then but he didnt

    An executor can only be appointed by a will. Until there is a grant of administration presumably to the person agreed by yourselves, that person has no legal standing. Look at courts.ie to see what is involved.
