I dont know is the answer. As far as i know..i'm not a lawyer but ..you actually can write down your own will and get it witnessed - ask someone you trust or a peace commissioner/ commissioner for oaths is better again.

As far as I know - a lot of solicitors are commissioners for oaths, the cost is ten euro for this service. I think its cheaper if you do it this way rather than gong into a solicitor for an appointment to make a will, because the solicitor can charge you for advice.

Write your will and go to a solicitor to get it signed officially.

If you're going to be stingy and not get a solicitor to draw up the will it would be complete lunacy to then pay someone to witness it.

A witness to a will does not have to be a Commissioner for Oaths or a Peace Commissioner, all you need are two people who are not beneficiaries or the spouses of beneficiaries, get them to stand over you as you sign the will and then get them to sign as witnesses. It's ok for the person named as executor to be one of the witnesses, provided that he/she is not a beneficiary.

    S.78 Succession Act 1965

78.—To be valid a will shall be in writing and be executed in accordance with the following rules:

    1. It shall be signed at the foot or end thereof by the testator, or by some person in his presence and by his direction.

    2. Such signature shall be made or acknowledged by the testator in the presence of each of two or more witnesses, present at the same time, and each witness shall attest by his signature the signature of the testator in the presence of the testator, but no form of attestation shall be necessary nor shall it be necessary for the witnesses to sign in the presence of each other.

Mylelf and the missus made a will a few years back - I think it cost €80.
Half an hour with a solicitor and there ye go - job done.

That good value at eighty euro, I would definitely go to a solicitor at that price as opposed to my stingy alternative. ;)
