Not surrendering a licence, question.

    Hi, I have 2 questions regarding the legal implications of not surrendering a driving license after a ban.

    1. What are the implications of not surrendering a full license, legally and regarding getting back on the road.

    2. Same question, but with respect to a provisional that went out of date at the same time a ban came into effect.

    Do you mean getting back on road after end of ban or getting back on road with an early restoration.

    There will be a requirement to have a valid in date licence endorsed, So I would believe in relation to a full in date licence, take same to the Court office that the ban was given explain that you forgot to hand in the licence, they should then send it to the county council who if the ban is up will endorse and return.

    It may be a bit more complicated in relation to out of date leathers permit, best to contact the county council, explain what happened, they will be able to tell you what to do. I would guess once ban is completed they will issue new learners permit with endorsement on it.

    I do not believe but am open to correction that there will be any legal implications. I know of people requesting an early restoration who did not hand in their licence, who then did so, and got early restoration.

    Is there not some implication for not handing up a licence? I thought it was an offence.

    Will they believe that you haev not been driving? NOt sure this makes any difference. Why not hand it in? Might seem naive but when my father got banned 25 years ago, I can remember him having 7 days post court to get his affairs in order and hand up his licence.

    :D I'm looking for information regarding the questions I asked, not looking for reasons not to hand up my license (thankfully I'm not in that situation).

    If the comments aren't helpful then perhaps you should really speak to a solicitor. Or FLAC.

    A driving ban is a disqualification from holding a licence. If you continue to hold your licence, then you are breaching the terms of your disqualification, and it seems to me like you could be charged with contempt of court or something similar.

    Find the solicitor that you had when you got banned and ask them. No-one here can tell you for certain.

    Thanks for the reply, though the above could be tricky since I'm not banned or have/had a solicitor. I'm just looking for information that I can't find online and wouldn't be worth contacting a solicitor for (I'm assuming they would charge).
