Legal ownership of contract phone

Once a phone is purchased/ given free on a new or existing contract does it become the full property of the customer even if they don't honor contractual bill payments?

Interested in buying a second hand phone but am worried about it being either remotely disabled/ or being claimed as property by the operator due to the original purchaser not honoring their bill payments.

Does any one know or is this a legal forum question?

    Thanks

go to the networks site and check the disclaimer in general they own the phone until your contract is up,if they breach contract they can ask for phone back or else you pay the balance in accordance to bill
