To make a long story short. Sony's PS3 service got hacked a few months ago. They offed compensation to users by offering two free games. Seems the electronic giant doesnt want to be sued if any more attacks happen. So they have plans to basically "force" its ps3 users to accept the new T&C or face a "console ban" (inability to connect to the net and play online for the non-gamers out there)

Thats pretty bad. Wonder if other companies will get inspired from this? "forcing" you to accept their T&C's. This could mark the way for companies to pretty much demand/set their own rules to anything they want.

I don't see the big deal? I was forced to accept the Boards T&Cs when I signed up, as I do with most websites and services.

T&Cs are a fact of life, most things we do that use the services provided by others have them!

For example: something like driving a car has T&Cs, you obay the rules or the license is revoked! The road is provided and we must follow the rules of the road.

Yes but surely what is contained in the T&C's has to be somewhat fair. I think this is the point of the OP's post. Not just because there are terms and conditions but the updated strictness of them.

By issuing this demand they are pre-emptively taking any legal action that you could suffer from another attack. Ie, your credit card could get stolen from another attack and get charged with 500 euro worth of goods. Tough sh*t Sony says. You agreed to the service. Its a waiver.

You didnt provide your credit card details when you signed up to boards. Imagine if you did. Its information gets stolen. You got no comeback.

It depends on what you mean by fair, if they're (1n your opinion) unfair don't sign up, if they lose a sufficiently large number of subscribers, they'll have to rethink.

I am getting the impression many people are in the dark about this choice by Sony
The gaming community has a massive online userbase. The ps3 came out in 2006 with its online service for free. You buy a game (latest titles costs 50-60 euro) and thats it. You are free to play against people online.

Now Sony wants to change that. They want you to continue playing online (as its a core part of the gaming business) but if your credit card info now gets stolen. Tough Sh*t. But they still want you to pay the 50-60 euro for the latest game even if you decline the new T&C.

Imagine the ipod (which has been out years) suddenly changed its T&C. In order to upload new music to it you have to accept a ridculious agreement by Apple. That if their itunes store is hacked. You can not hold them responsible. Even if your card was used and you are not getting billed for stuff you never bought online.

The T&Cs now state that you can't sue Sony. Whoops missed it in the thread body :S.

Perhaps you could sue the third party responsible for their data security!

See for me. This isnt about "oh my card info got stolen! who can i blame! who an I sue!" ... By entering information online. You take the risk at your end. As your pc might be infected. But at the other end (the company) you trust that their end is secure. Especially a giant such as Sony (ebay, amazon etc are no different)

So by Sony issuing this T&C they can pretty much have more back doors than a brothel with its security. And there is nothing you can do. And obviously at the same time they are not going to let its users know about its security.

But part from credit card information. This move by Sony pretty much marks a new way companies can issue things when it comes to their products or services.
