Registration of Rights of way

    Wondering about the new process for Right of Way registration. Apparently the dominant tenement owner can have the servient tenement owner sign off acknowledging the right of the other person with respect to the easement.
    Does the registration reflect the past use only of the easement?
    How can one ensure that there will be no intensification of the right of way, for example a small boreen which may have been used for agricultural purposes, suddenly having to cope with 40 tonne articulated lorries drawing timber, or the property being subdivided into housing lots? Possibly this would not be classed as intensification? Just a thought.:confused:
