Change of vehicle ownership process - swift answer appreciated!

    Hi all,
    A friend of mine sold his car to an acquaintance about 2 weeks ago. The cash has been handed over and the vehicle change of ownership form has been completed and sent away as of last Friday week.

    The buyer is looking to take the car asap as he needs it for work, but he still hasnt received the cert of ownership He says it's his because the paperwork has been filled out, but my friend doesn't want to give him the keys until he has the form.

    My question is, has the car legally switched hands yet? I'm looking at the Motor tax online site and when I enter the reg details, it states that there has been no change of ownership in the last 3 months.


    Change Of Vehicle Ownership - No Changes notified in the last 3 months

    The car was his as soon as the form was filled and the cash changed hands, your friend has NO reason not to give him the car.

    That's unbelievable.
    How can someone pay upfront for a car, and not take it for 2 weeks?

    Rule is simple - fill in paperwork, pay, take the keys and drive off.

    So your friend has the cash and the car! very trusting buyer. He must hand over the car once signed and paid.
    What I do when selling is type out a simple document in duplicate stating that car has been sold to whoever at time & date for x amount. Both parties sign each copy and each person keeps a copy. This is to avoid any confusion later.

    I did a change of address on a car recently and it took over 4 weeks for the registration certificate to come back so the seller may pay his buyer interest on the money if he wants to make him wait that long!

    Once your friend has agreed price, and the other guy has paid, its his.

    The buyer is now in the position that if your friend gets a ticket, it could go to the new buyer as by the time its processed the owner could be showing as him, with the change of ownership being recorded as the date on the form he signed.

    Haha, I know little about cars guys, and no I'm not a mod of Motors lol :pac::pac::pac:

    My friend is concerned that the form has gotten lost in the post as the change in ownership has appeared on the motor tax site.

    I think his main concern is the form is lost in post and, Murphys law, the other guy has an accident. Nervy guy probably, but it's the first time he has done it.

    Even if the other guy does have an accident, it'll be on his own insurance. Tell your friend to chill out and say goodbye to the car.:)

    I am sure that your friend has given the buyer some sort of handwritten reciept for the money. Get a similar item done where the buyer signs that he received the car on xx of Sept 2011.

    Its no longer your friends car!

    Man, that is unbelievable. Tell your friend to hand over the keys sharpish, not only is your friend holding on to goods that are no longer his, if he still has insurance on the it will more than likely be invalid from the moment he signed the change of ownership form.

    In other words, your friend could be in a far worse position for holding onto the car while actually mistakingly thinking he was covering himself.
