Resignation Issue

    :( Hi All, I'm looking for some advice here as soon as possible. I have resigned from my job as I got a new job with a better company! I have wanted to get out of my current job 4 quite a while as they r horrid ppl to work for! Anyway, a colleague who also felt the same quit a month ago and handed her notice in on the wednesday and finished up the following Tuesday week! I gave my notice on Monday just gone and he is saying that I have to come in on the Monday 19th, although I have agreed to start my new job that day! From my understanding the resignation takes effect from the day u resign, meaning I would have given my 2 weeks, mon-fri & mon-fri following week! He allowed my past colleague to do this and never said anything, when I brought this up he said that she handed hers in the morning and I handed mine in at lunch! I just want to know does the day I hand in my notice, does my 2 weeks notice begin on that day??? He's just being awkward and a bully, it also means that I wouldn't get paid for 2 weeks later as I'm back week and would be 4 the 1 day, Monday!! I also had annual leave booked to go on the 19th for a week( last day he wants me to work) which he signed off on in July, would this make a difference?? Please help, thanks!!!

    Managers can be d!cks and the favouritisms do be vomit inducing - just dont show up on the monday - whats the worst thing that could happen?

    I'm afraid though that if I do that, he won't pay me or give a bad reference etc( which he prob will anyway out of badness) I've tried to get some info on the net to see if the day you resign counts as a day but all it says is 2weeks!

    I have had this before in 2 previous jobs and i just told them, Sorry but i will not be available for work that day as i will be in my new role.

    It worked both times and didnt affect my reference or anything..

    What does your contract say in regard to notice

    Actually the more I think about this the more pissed off I get firstly in relation to my last post firstly check your contract I will assume it says two weeks notice is required as you have stated it is two weeks ( if or is not on your contract let us know)

    tell him you have given two weeks notice and you won't be be in on the Monday I would advise you to do this on writing ( email etc) if he gives you any hassle ask him for his response in writing

    I doubt he will give you anything in writing but if he tells you verbally about non payment no ref etc write this down in front of him while he is speaking

    Then tell you are contacting NERA to report him and while your at think about anything to do with any illegal activity the company is engages in - cash payments , no manual handling training , waste disposal you will come up with something

    Finally tell him to grow up and explain to him why you are leaving and all your friends on boards.ie think he is a prick

    Haha, thanks my boards friends!! My contract states 2 weeks but I'm just not sure as to what day that 2 weeks starts ya no! Yeah I think il do that and see how I get on! They have knocked everybodies confidence nd everybody is so scared to say anything to them! Trust me I have left d place many a day in tears and don't really know why I'm letting it bother me over resignation but I just dont want them messing up my new job opp 4 me ya no! Oh employers love dis darn recession!!:(

    Like I say tell him out straight you won't be there and any hassle from him you will take it further mention if you like your uncle is solicitor and he has advised you to get any discussion in writing- most bullies back down when confronted ( btw I act on behalf of an employer and I would never dream of treating some one this way - your moving on and he should accept this the fact the he is making you work your notice means you have been a good employee up to this ) and finally tell him to pluck off the prike

    You will be well rid of this clown! I'd agree to give it in writing saying you intend to finish on the Friday (date the letter last Mondays date!). If he persists, you had leave booked and signed off anyway for Monday 19th. For all he knows you could have been leaving the country to go on hols for the week, none of his business either way, so tell him to count it as a holiday day (actually half day - as he pointed out, you gave your notice at lunch time) if he wants to be so petty.

    I think that technically he's in the right: a day counts as part of your notice if you hand the resignation in before half the day is over.

    The others are right, he's being a dick.

    How much does the relationship with him matter: is it a small industry? What's the chances that you'll work with him again? (remember, the country is a small village). All these things affect how you handle it.

    Me ... I'd be inclined to let him know that either you finish on the Friday, or you'll call in sick on the Monday. His choice. ;)

    He's being a total dick! Even if he is technically correct, it is human to think "Ah Jaysus I'll let him finish up on the Friday!" and not force you to come in on the Monday.

    Why do you think he's being such a dick to you? Is it possible you have been a dick to him and he is taking his petty revenge? The reason I say this is just that it's always worth examining your own behaviour to see if any of the bad karma you're getting could have been prevented!

    No I know how to respect and treat others with respect, my employers are no different. I will be the 5th woman to resign from the office this year, leaving 1 left! This person is this way with everybody but I think cos I allow it, he seems to come down harder on me. Sure il tell ya this, my father took ill abroad earlier this year, I had to go there to be with him immediately, whilst I was there, I was assured that I would be paid holidays and I could take as much time, I took 2 weeks and then came back, wait for it...to which I received a warning for my attendance and I never got paid! Its just impossible to compete with people like this hence I am sooooo happy to have bagged myself this new job and to be honest I actually think that, that is what is bothering him, the fact that I have said enough is enough and got myself a new job with more salary, closer to home, perks and no doubt where I will be appreciated. I have been with them now nearly 3 years and I dont think that I should be treated like this because I want to move on in my career. I think thats the best idea, I should just go on there and tell them Im finishing Friday, that I gave me 2 weeks (mon-fri & mon-fri) because as far as Im aware, your notice comes into affect the day you resign! Thanks all for your comments!!

    Tell him you are off that day on annual leave which has been approved so it doesn't matter what time of the day you handed in your notice, you'll be at work from a wages point of view that day but on annual leave. He has no leg to stand on.

    I heard from a fairly reliable source that it's illegal for an employer/tutor/whatever to give a bad reference. What's missing from a good reference is how they get around it, but he can't write anything nasty about you, and besides you've an awesome new boss that'll have the important reference if you ever need one again :)
    Best of luck with the job and don't show on the Monday. He's signed you off for that day and worse case scenario he doesn't pay you half a day if he's still pedantic. I'm sure cutting your loss of that half day+bags of stress that come with it will be easy with the new job, you'll probably be so busy trying to get everyone's names down etc that you'll just think "ahhhhhh, this is MUCH better" and so on! And new job'll pay you for all of that day also =D

    That's actually untrue, there is nothing illegal about a bad reference.

    You could of course take them to court saying they had slandered you, but if they had proof to back up their statements (e.g. proof you were disciplined for being late X times) you would lose the case!

    I would rather not go that route as dont have the energy but if I was I would have plenty of back up, recordings of his abuse etc. He put a verbal warning on my file as I said about when I came back after my father been ill. He tried other things aswell but when I asked for hard proof he backed down and changed his ways. He has also given a warning to one of my colleagues as they were new and struggling getting adapted to the job, like its just a power issue with him and nobody likes him. Karma is a bitch, and I think it looks really bad that all the women except 1 have resigned this year. I am really looking forward to starting the new job but would just rather end things on a good note as previously mentioned and be allowed leave with respect. God this has turned into a councelling session ha!!

    This. If your employer wishes to change your annual leave, he must supply you with at least a month's notice.

    So tell him your last working day is the Friday, he can take the half day Monday out of the annual leave that you booked in July.

    He cannot withhold wages or a P45 under any circumstances. If you've already secured the new job, then don't stress too much about the reference.

    There is some really really poor advice being given in the thread (not Seamus'), OP, stick to your guns, your notice is handed in, your annual leave was booked in advance.

    To reiterate this for him tell him that you have clarified this with

    Employment Rights Information Unit

    Tel: 01 631 3131
    Lo-Call: 1890 201 615

    and that if he doesn't playball you will be pursuing a case to the rights commissioner under the payment of wages act, because you will not be in on the 19th ;) That's if he expects the 19th to be one of your days of notice :)

    Job jobbed then I would think.
