Extremely weird email from CeX dublin about my phone insurance claim :S

Need some advice over this what do i do ?? .. long story short got insurance for my iphone 4 with cpp phonesafe insurance through meteor.

I lost it on the 1st of August. Made a claim forms documents sorted no problems there.. And now like 5 weeks later i got this email from CeX shop in town stating that i sold them the phone !!! Its a shop where they buy and sell electrical goods.

I was thinking the place where i lost my phone was in and around my area so whoever found it could have known and could have possibly sold the phone onto them ?? Chances of that are slim but its possible i guess ?????

I do have a membership for this place. But i DID NOT sell them this phone !!!! I dont even know how the person who sold it to the shop if they did knew that i had a membership with this shop.. or maybe they didnt and just chanced it i dont know ???

Their basically saying that im a fraudster like

    Heres the email..

I am writing to you from CeX, Co.Dublin

On August 4th you sold us a white iPhone 4

The IMEI of the handset is ........

You received €357 for the phone.

On August the 1st an insurance claim was made against that same handset with CPC Phonesafe.

As you signed a declaration with us on August 4th, stating your ownership of the phone and desire to sell the phone to CeX, thereby relinquishing ownership, this insurance claim must be in error.

We have tried to contact you several times over the last few days to discuss this matter but have been unable to reach you.

Can you please reply to this email as soon as possible with a time and method by which we can contact you to discuss this in detail. You can also choose to return to the store.

If we do not hear from you by 5pm on Friday September 9th 2011, we will have no option but to contact the Gardai and report a potential case of fraud regarding the insurance policy on this phone.

I sincerely hope to hear from you soon so this situation can be resolved.

    Regards.

Im absolutely outraged and appalled by this it doesnt it look like that ill be getting back a phone that cost 610 euro that i genuinely lost and had valid insurance for

Do i just go into the shop and explain that it wasnt me who sold it to them ?? I cant see them believing me at all though considering i do have a membership with the shop

Any advice would be appreciated thanks

First of all ask them for signature that you made when you gave the phone, second thing would be checking their cctv....third one, if they gave you receipt there should be a time on it so maybe you could prove that you weren't there at that time...college,work,abroad etc...

First what you need to do is make a report to the Gardai, they can advise you after that.

In your view what do u think the gardai would do or say to me ?

I'm not sure mate but if I was you I'd get down to a station quick smart and show them the letter. You're innocent so you've nothing to fear, they might pop into CeX and make their own inquiries. As far as you're concerned your phone was lost and now CeX have it, they have stolen property belonging to you and the Gardai will be able to help you retrieve it.

Thats okay that makes sense thanks ! What if cex have already sold my phone onto someone else ??

Silly question and shoot me down, how do CEX know your email? Someone you know sell it? Dont you need to provide ID etc?

see thats the thing.. i do have a membership with them . u give an email when signing up... u only need id when your setting up a membership with them not when your buying and selling goods.

Its highly highly unlikely but it is possible that someone mightve found it that i know .. knew it was my phone.. and gave it in possibly ?? Chancing their arm

Im even doubting my good mate might have done something because we had an argument the other week.. and were not talking and stuff.. And ive also lost my memebership card with them as well strangely enough !!

I admit it does sound dodgy coming from my part

Well they've already stated that they have your phone so if they've sold it I'm sure they'd be liable to replace it. Once you involve the Gardai they won't be long in informing you of your rights and I don't think any third party will mess around. Shouldn't take you too long to get your phone back.

But make sure you contact the Gardai, that will keep everything above board and you won't get into a "he said, she said" argument with cex. It will also show that you've nothing to hide and that you're not a chancer.

Reply to them stating that you didn't sell them the phone.
State that you take the accusation of fraud very seriously and have contacted your family's solicitor.
Request a copy of the signed form, the timestamped receipt, and any other documentation.
Also request a copy of the CCTV as the stolen iPhone was reported to the Guards, and it is an important piece of evidence, and may help you find who ever stole it (as they obviously were the person who handed it in)

BTW, I don't fully believe that you didn't sell it to them and are looking for a way out.
I don't know you, so am not commenting on you as a person. It's just far more likely that you lost it and claimed on insurance, then it turned up you sold it (or maybe it was never lost).
That scenerio is far more likely than the guy who found it happened to go to the shop where you have an account, and gave your name, and your details, and sold it that way. I'm pretty sure guys who steal/find fones don't get rid of them that route very often.

Even if you do have a membership, how did they link that particular iPhone to you?

    Sorry, double post.

The person selling the phone could have checked the email in the phone settings, it would be fairly stupid to do that though, something doesn't add up about this whole scenario

As part of the insurance check (having made the claim) the company could have ran a check for the IMEI number, and through up this CeX issue - which would link the IMEI number back to him (through the insurance document).

I'm of the same opinion as Mellor too.
If this is genuinely what happened though
I'd request the paperwork which was signed when the phone was traded in also CCTV footage of the sale.
They should be able to tell straight away if it was you or not comparing previous documents filled in or signed by previous sales

Ah lads you don't know that, he might have sold the camera and other stuff to buy the iPhone. If it's a scam...stupidest scam ever, never get away with it.

imei number i guess.. but heres the catch the imei number that i have on my insurance documents doesnt match the imei on the iphone that cex have

Got some good news and bad news:

Good news: Gardai are completely on my side ! Seen all my evidence showed the garda the copy of the email and they copied all my documents just in case they are needed for future use. Gardai were very helpful actually she even said "if he wants to report you let him" !!! I was thinking of going back down to the station tomorrow and ask them for a quick short recommendation in writing to the store manager for him not to report me ?

Bad news: Store manager in cex no luck with him shook his hand seems like a decent bloke.. But he said he was in "contact" with just one member of the insurance company not the actually company itself.. I told him id give her a ring tomorrow.. maybe this woman could be an investigator ?? just before i left the shop he did say maybe that i can pay back for the phone ? But ehh i dont want it !!! I want my claim to be successful for the phone that i genuinely lost thats what i want and i intend to get it !!!!

Well i think anyone would take being accussed of fraud as serious would do..

they did not show me cctv and any sort of signature what so ever... NOT SURPRISED THERE !

I think to be talking about solicitors is a tad bit too early.. Him saying that i could possibly buy the phone from them sounds like hes trying to make a compromise with me

Well u can believe what you want to believe thats your choice

Assuming this is legit, if the IMEI numbers don't match, what's the problem? You lost one and sold another. Nothing to see here.

  • Registered Users, Registered Users 2 Posts: 40,234 ✭✭✭✭Mellor

Well it's possible to change a phones IMEI number.

Also, re-reading the email, they never said it was the phone he claimed against. He says he traded in a phone and claimed ownership of it, and there was a claim against it. It's possible that they are suggesting that somebody else claimed against a different phone, and his claim of ownership was fraud

Would your network provider not have a note of your imei on their files ? - I;d have thought you could have phoned them, got the correct imei & sorted which one was yours..
