Israel Would View ICC Investigation as "War" by the PA

    A newly released cable reveals one of the reasons Israel is objecting to PA statehood is because it would give the ICC jurisdiction to investigate alleged war crimes committed in Gaza during Operation Cast Lead. Israel is so fearful of being pursued through the ICC that it has threatened to go to war.

    Summary: IDF Military Advocate General Mandelblit updated the Ambassador on February 17 on the progress of investigations into allegations of misconduct during Operation Cast Lead, including providing a preview of additional findings to be published before the March 24 Human Rights Council meeting. Mandelblit noted concern with the Palestinian Authority’s effort to undermine Israel through the International Criminal Court and hoped the U.S. would weigh in with both the PA and the ICC, and publicly state our view of the ICC’s lack of jurisdiction. He warned that PA pursuit of Israel through the ICC would be viewed as war by the GOI.

    So what can we expect from Israel? another all out assault on Gaza? and hundreds more dead civilians? Whatever happens, it's quite clear from this cable that the Israeli governing elite have lost all sense of reality.

    Its ridiculous for Israel to view non-violent resistance by Palestinians like this as an act of war. Its seems that anything other than complete compliance is viewed as being no different than terrorism. It shows how extreme Israel has become imho.

    If Israel truly believes, that they acted properly, then they surely have nothing to fear, and can easily provide a defence, but this over the top reaction show me that either Israel knows it did something wrong, or thinks that the law does not apply to them.

    No surprise that some on here would misinterpret a cable and make a mountain out of a molehill. I guess in your world 2+2 = 63434645631341

    It said "PA pursuit of Israel through the ICC would be viewed as war by the GOI. (Gaza Operation Investigations". By war they presumably mean diplomatic war. In no part of the cable was there even a hint that any action would be even considered against the PA or Palestinian territories.

    In light of Israel's record on how it treats its perceived or imagined threats I would be more inclined to believe your presumption is incorrect. Even if you're right describing the referral of a case to the ICC in those terms is highly provocative. If Palestine becomes a UN member state it would be perfectly entitled to refer a case to the ICC and don't forgot that both sides would be investigated not just Israel.

    Further on in the cable the IDF's top lawyer states
    that the ICC was the most dangerous issue for Israel…

    To consider the ICC more dangerous than Iran or Hamas rockets is quite disturbing and shows how far outside of reality the Israelis have slipped.
