Garage chasing me for service history

    I recently traded in an 11 year old car (which I've had for 3 years) and assumed this was "sold as seen". No mention of service history etc by the garage in ANY conversation, although I had mentioned that I had had it serviced recently by a Ford garage (its a Focus).

    Now they're chasing me, saying that I "signed a legally binding document" etc. and Im sure they use these heavy handed tactics with everyone. Saying that "it was serviced according to the manufacturers schedule" etc. I gave them a copy of the last 2 service records that it had, which I think is adequate, given I only have the car 3 years. As far as I can see, there is nothing in this "legally binding contract" that requires me to produce the FULL service history.

    Has anyone had any experience dealing with garages like this? Has anyone any (albeit IANAL) legal advice?

    That's a new one on me, especially for an 11 year old car. I presume you both have a copy of whatever you signed - what does your copy say?

    Sounds like it was while in your care, how are you supposed to know what the previous owner did? Caveat emptor applies to dealers taking trade-ins as well as Joe public.

    This garage obviously has too much time on it's hands and would do better chasing sales than harassing existing customers.

    Its in my new car, I'll check later and post. I scanned it last night, but nothing screamed out at me. I've contacted SIMI too to see what they say (although Id assume that their loyalty will apply wholly to the dealer).

    This is crazy stuff. Did you come across as a bit of a push over when buying I wonder? Next thing they will be looking for a cash adjustment to compensate them for lack of 'promised' history.

    Just do what the vast majority of garages do when you need something from them.

    Tell them you'll need to go get the paperwork, and you'll call them right back..................

    They will soon get bored of ringing.

    Ha! I may have done, yes! Good luck to them looking for a cash adjustment. I have no problem spending an afternoon in the Small Claims Court, I have a book of Sudoku that needs finishing..

    Ignore them, there's nothing on an SIMI order form that says you must supply a fully documented service history.

    Dealer wants service history to give to potential new buyer - what's wrong with that? I thought that would be a good thing!

    The garage is responsible for what they bought - they carried out a trade without checking out fully what they were buying. Their own stupidity really, they should know better given that its their livelihood!

    Like you buying a car and then realising it had bald tyres - if you went back to the garage to ask for new ones, they'd have no issue telling you where to go with yourself.

    +1 (Just bought car last week and can confirm this - one I traded in didn't have a FSH)
