Car failed NCT, trading in?

    A question for a friend of mine:

    She is trading in her BMW 318 (2000 reg) for a new mazda 6 (2011). The BMW failed the NCT today on worn ball joints and a spring. The dealer has already test driven it a week previous, was happy with it and offered and agreed a trade in price with NCT. Understandably she is not going to pay for repairs but just trade in as agreed, just telling the dealer she won't NCT it instead. He'll probably agree a new lower price to take into account he needs to do the NCT (or he'll just sell it to the trade?).

    Can the dealer find out it's failed before? Can he come back to her and chase her for money?

    She is being dishonest. Why are you trying to help her?

    She made a deal and is now trying to get out of her end of it.

    I'm just wondering if it's likely she'll be hounded by the dealer. I don't like it personally but she is going ahead. Will he be able to find out that it failed the NCT before?

    Yes, when he goes to NCT the car , they will tell him that it failed and on what issues. They automatically do that , as it is now a retest. If he is a dealer then it's buyer beware . It's a funny one as he is willing to take a chance on the car , so I wouldn't worry too much about it. If he took it without nct , he is valuing the car as one that may need work for the nct.;)

    Why not just tell the dealer the truth? There won't be much money in it, and it's the decent thing to do. I can't imagine she'd be too happy if a dealer treated her like that.

    Ah misread that post and thought that the deal had already been done without nct. She should at this point tell the dealer the truth if she is going to sell with failed nct ;)

    Sorry she has clarified and said there is no deal done, just prices assuming a valid NCT cert on the car. Tax is up aswell next month so she said she'll simply tell the dealer she doesn't want to spend money on NCT and tax on her old car. The trade in price will probably come down.

    So she's thinking of telling the dealer that she never went for the NCT, rather than admitting that she did and it failed? I don't think they'll chase her for it, but it is a sh1tty thing to do and it may well leave the dealership with a sour taste in the mouth.

    She's being pretty stupid if she's buying her new car from them. What happens if she has a problem with her new car a month or so down the line and tries to go back to the dealer for help? I can't imagine they'd be overly accommodating if she tried to stiff them with the trade in.

    I think her line of thinking is, they won't know it failed. Especially after a month as then it's a full test rather than a re-test that's needed. It would be as if she didn't take it to the NCT today at all. I don't know if this is true though?

    He'll find out if failed as soon as he looks at the screen for the new disc, you won't find many total gobsh1ts selling cars these days ;)

    Just tell her to be honest, they probably gave her a tiny actual trade in price anyway on it.
