    is it correct that you cannot have proceedings in the circuit court heard while you have a case going on in the district?

    Exactly what kind of 'proceedings' are we talking about?

    If there is a criminal case pending then no civil proceedings can be heard in respect of the same incident so if someone assaulted you and was charged with assault, you would not be able to sue them for damages until the criminal case had been disposed of.

    going thru separation proceedings..doing access, maintenance in court as ex refused to agree to any type of separation agreement. my solicitor reckons we cant go ahead with judicial separation in circuit court until all district matters are done (ex keeps adjourning)...this was my q

    well just got divorce papers in the post from his solicitor even tho we have been sep for less than the 4yrs needed and also even tho these other cases are still on the go...so im left wonderin who is correct here
